Bylaws Coverage Addendum Revisions

The UCIP Board of Directors recently approved revisions to the UCIP Bylaws Coverage Addendum, effective March 1, 2021. The overall reason for revisions was to make the document more reader-friendly and incorporate some improvements to coverage. The new Bylaws Coverage Addendum can be viewed on the UCIP website.

The main purpose of these revisions was to reorder and renumber the document to have it coincide with the structure of the UCIP Bylaws, of which the Coverage Addendum is a part. The revisions also split up the prior General Liability section and created separate coverage parts for General Liability, Law Enforcement Liability, Public Officials Liability and Employee Benefits Liability. Having these separate coverage parts will help staff and members better delineate which coverage part a claim will be covered under. Nearly all the endorsements which appeared at the end of the document have now been incorporated into the different coverage parts, making the document much easier to read without paging back and forth to the endorsements section.

The revisions effective March 1 also included some changes to coverage in several different coverage parts:

Changes to Property included adding coverage to underground fiber optic cables, coverage with a large sublimit to mold arising from a covered loss, and a sublimit of $500 for physical damage to a vehicle or mobile equipment owned by an employee or volunteer for county activities, without the need for the employee or volunteer to have physical damage insurance on the vehicle or equipment.

Changes to Privacy or Security Event Coverage (formerly Cyber Liability) includes coverage for damage to Electronic Equipment and Electronic Data caused by an event, coverage for Network Interruption Costs, and coverage for PCI-DSS Assessments.

The exclusion to claims arising from land subsidence in the liability section was removed based on UCIP’s success in securing reinsurance for these claims.

UCIP will conduct a thorough review of the new Bylaws Coverage Addendum and all the new coverage introduced over the last year at the annual Risk Coordinators Workshop, tentatively scheduled for April 29, 2021. In the meantime, if you have any questions on the new format of the document or coverage provided members under the Bylaws Coverage Addendum, contact Johnnie Miller at jmiller@ucip.utah.gov or 801-718-7107.
